Terms of Service

Acceptance of terms

These Terms of Service (“Terms”) are a legal agreement between you and EightFive Technology (“CaddieSight,” “we,” “us”) governing your use of the CaddieSight website, apps, and API (the “Service”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

The service

CaddieSight is an AI-powered digital caddie. You capture or upload a photo of your ball's lie, add shot context such as distance and lie notes, and the Service returns club, stance, and swing recommendations — which it can read aloud. The Service also lets you import swing data and manage golf gear and courses. Features may change, and we may add or remove functionality over time.

Accounts & sign-in

You sign in through Microsoft Entra External ID using a supported social account (Google, Facebook, Apple) or email. You are responsible for maintaining the security of your account and for all activity under it. You must provide accurate information and be old enough to form a binding contract in your jurisdiction.

Your content

You retain ownership of the photos, swing data, notes, and other content you submit (“Your Content”). You grant us a limited license to store, process, and use Your Content to operate and improve the Service, including generating recommendations. You are responsible for ensuring you have the right to submit Your Content.

Acceptable use

You agree not to:

• Use the Service unlawfully or in violation of these Terms.
• Upload content that infringes others' rights or contains malware.
• Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service.
• Misuse the API, scrape data, or exceed reasonable usage limits.
• Resell or commercially exploit the Service without our permission.

AI advice disclaimer

CaddieSight's recommendations are generated by AI models and are provided for informational and entertainment purposes only. They are estimates based on the photo, context, and data you provide, and may be inaccurate or incomplete. You are responsible for your own decisions on the course, including club selection and swing. Always assess your surroundings and play safely. CaddieSight does not guarantee any particular result or improvement in your game.

Third-party services

The Service integrates with third parties such as identity providers, cloud infrastructure, and golf course data catalogs. Your use of those services may be subject to their own terms, and we are not responsible for third-party services or content.

Intellectual property

The Service, including its software, design, branding, and content (excluding Your Content), is owned by EightFive Technology and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial golf use.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.

Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Limitation of liability

To the maximum extent permitted by law, EightFive Technology will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or USD $100.

Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Continued use of the Service after changes means you accept the updated Terms.
